Privacy Policy

This Privacy Policy explains how Fusion Telemetry Pty Ltd (ABN 33 693 516 719; ACN 693 516 719) ("Fusion", "we", "us", or "our") collects, uses, discloses, and protects your personal information when you use the Fusion Telemetry website, dashboard, and related services (the "Service"). We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1What personal information we collect

We collect the following categories of personal information:

Telemetry & performance dataLap and session data, sector and timing data, speed and RPM, and GPS location traces from your sessions, together with coaching insights derived from them.
Uploaded filesData files you voluntarily upload (for example, CSV exports from third-party data loggers) and their contents.
Payment informationSubscription status and billing identifiers. Card details are collected and processed directly by Stripe; we do not store your full card number.
Social & preferencesFriends, clubs, leaderboard entries, notifications, and your privacy and notification settings.
Technical & usageInformation generated when you use the Service, such as session/authentication data and basic device or log information needed to operate and secure the Service.
CommunicationsMessages you send us, such as support requests.

GPS location traces can indicate where and when you drove. We treat this as personal information and handle it with the same care as your other information.

2How we collect it

We collect personal information:

  • directly from you when you create an account, complete your profile, upload data, contact us, or adjust your settings;
  • automatically when you use the Service, through authentication and basic technical information needed to run it; and
  • from our service providers, such as Stripe, which confirms your subscription and payment status to us.

Where you upload data that relates to another person (for example, a co-driver), you are responsible for having any consent needed for us to handle it as described in this policy.

3Why we collect and use it

We use personal information to:

  • create and manage your account and provide the Service;
  • process, store, and display your telemetry and generate insights, charts, maps, and leaderboards;
  • operate social features (friends, clubs, driver search, and public profiles) according to your privacy settings;
  • process subscriptions, payments, and renewals through Stripe;
  • send you service communications, such as confirmation, password reset, billing, and account notices;
  • provide support and respond to your enquiries;
  • maintain the security, integrity, and performance of the Service, and prevent misuse or fraud;
  • send marketing communications where permitted (see Section 4); and
  • comply with our legal obligations.

4Marketing communications

We may send you marketing communications about Fusion features, offers, and updates where you have consented or where otherwise permitted under the Spam Act 2003 (Cth). Every marketing email includes an unsubscribe option, and you can also manage your notification preferences in your account or contact us to opt out at any time. Opting out of marketing does not stop essential service communications (such as billing or security notices), which we need to send to operate your account.

5Who we share it with

We do not sell your personal information. We share it only as needed to run the Service, with:

These providers may only use your information to provide their service to us. We may also disclose personal information where required or authorised by law, to enforce our Terms, to protect the rights, safety, or property of Fusion or others, or in connection with a sale or restructure of our business (subject to appropriate protections). Other users may see information you choose to share through social features, according to your privacy settings.

6Overseas disclosure

Your account and telemetry data are stored primarily on infrastructure located in Australia. However, some of our service providers listed in Section 5 (including Stripe, Resend, Google, and Netlify) operate or store data overseas, including in the United States. Where we disclose personal information to overseas recipients, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles.

7Cookies & tracking

We use cookies and similar technologies that are necessary to operate the Service, primarily to keep you signed in and maintain your session securely. We do not currently use third-party advertising or analytics trackers. Our track-map feature loads Google Maps, which may set its own cookies as part of providing that map. You can control cookies through your browser settings, though disabling essential cookies may prevent you from signing in.

8Data security

We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. These include encryption in transit, hashed password storage, access controls, and row-level security that restricts your data to your account. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a data breach likely to cause serious harm, we will respond in accordance with the Notifiable Data Breaches scheme under the Privacy Act.

9Data retention

We keep your personal information for as long as your account exists, including if you cancel your subscription, so that your data and history are available if you re-subscribe.

  • Deletion on request. You can ask us to delete your account and associated data at any time. When you do, we delete your account data, other than information we are required to keep by law.
  • Billing records. We retain transaction and tax records for at least the period required by Australian law (generally five years).
  • Inactive accounts. If your subscription has been cancelled and your account remains inactive for 24 months, we may delete it and its data after giving you notice by email beforehand.
  • Backups. Residual copies may persist in routine backups for a limited period before being overwritten.

10Children & minors

Account holders must be at least 18 years old. We do not knowingly allow anyone under 18 to create their own account. Because motorsport includes young drivers, a parent or guardian may hold an account and include data relating to a minor driver in their care. If you do so, you are responsible for that minor's information and confirm you have the authority to provide it. If you believe a minor has created their own account, please contact us and we will take appropriate steps.

11Your rights

Under the Australian Privacy Principles, you can:

  • access the personal information we hold about you;
  • correct information that is inaccurate, out of date, or incomplete;
  • request deletion of your account and data (subject to the retention exceptions in Section 9);
  • export a copy of your data; and
  • opt out of marketing communications.

You can manage much of this directly in your account. For anything else, contact us at support@fusionracing.com.au. We will respond within a reasonable time, and generally will not charge for access requests. We may need to verify your identity before acting on a request.

12Complaints

If you have a concern about how we have handled your personal information, please contact us first at support@fusionracing.com.au so we can try to resolve it. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

13Changes to this policy

We may update this Privacy Policy from time to time. If we make material changes, we will take reasonable steps to notify you, such as by email or a notice in the Service. The "Last updated" date at the top shows when this policy was last revised. Your continued use of the Service after changes take effect means you accept the updated policy.
